Terms of Service

These Terms of Use ("Terms") govern your access to and use of the Haul Service. Please read them carefully.
1. Acceptance of Terms
By accessing or using the Haul Service, including by creating an account or booking a service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Haul Service.
You must be at least 18 years old to use the Haul Service.
2. Definitions
- "Haul," "Haulwerk," "we," "us," or "Company" refers to Haulwerk, LLC, a California limited liability company.
- "Haul Service" means the Haul website, Haul Dispatcher Portal, Haul consumer mobile application, Haul Driver mobile application, and any related services, tools, features, communications, or platforms.
- "Service Provider" means a third-party junk hauling company or contractor that offers services through the Haul Service.
- "User," "you," or "your" means any individual who accesses or uses the Haul Service as a customer.
- Haul and Haulwerk may be used interchangeably throughout these Terms.
3. Nature of the Haul Service (Marketplace Disclosure)
Haulwerk is a marketplace platform only.
- Haulwerk does not provide junk hauling or removal services
- Haulwerk does not employ Service Providers
- Service Providers are independent third-party contractors
- Service Providers are not agents, partners, or employees of Haulwerk
Haulwerk's role is limited to:
- Connecting users with Service Providers
- Facilitating booking, payments, and communications
- Providing tools, including AI-assisted estimates
All hauling services are performed solely by Service Providers. Haulwerk does not supervise, direct, control, or monitor the services performed by Service Providers.
4. Accounts & Eligibility
To use certain features, you may be required to create an account and provide accurate information, including a valid email address or phone number.
You are responsible for:
- Maintaining account security
- All activity conducted through your account
5. Booking, Pricing & AI Estimates
5.1 Estimates
Haulwerk may provide AI-assisted or photo-based estimates for informational purposes only.
You acknowledge and agree:
- Estimates are non-binding
- Estimates may be inaccurate or incomplete
- Final pricing is set by the Service Provider
- You agree in advance to pricing determined by the Service Provider at booking
5.2 No Price Guarantee
Haulwerk does not guarantee:
- Pricing accuracy
- Availability
- Job completion
- Outcome or quality of service
6. Payments, Fees & Refunds
6.1 Payments
Payments are processed through Stripe Connect. By booking a service, you authorize Haulwerk to:
- Collect payment on behalf of the Service Provider
- Deduct Haulwerk's platform fee
- Disburse remaining funds to the Service Provider
Haulwerk acts solely as a limited payment collection agent.
6.2 Fees
- Haulwerk charges a 15% platform fee based on gross booking revenue
- A booking fee may be charged and is non-refundable
- Any non-refundable booking fees will be clearly disclosed to you prior to checkout and payment confirmation.
6.3 Refunds
- Refund decisions are made solely by the Service Provider
- Haulwerk is not responsible for issuing refunds, except where required by law or platform integrity concerns
- You acknowledge that payment disputes, chargebacks, or reversals may result in suspension or limitation of your access to the Haul Service.
7. Cancellations & Disputes
- Any disputes regarding services must be resolved directly between you and the Service Provider
- Haulwerk is not responsible for service disputes, damages, or outcomes
- While Haulwerk is not responsible for resolving service-related disputes, Haulwerk may, at its discretion and without obligation, assist in facilitating communication between users and Service Providers for purposes of issue resolution
8. User Content & License
You may upload photos, text, or other content ("User Content").
By submitting User Content, you grant Haulwerk a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use such content for:
- Pricing and estimation
- Quality control
- Machine learning / AI model training
- Analytics
- Platform operations
- De-identified demos or marketing
Such use of User Content is limited to operating, maintaining, improving, securing, and demonstrating the Haul Service, including the development and improvement of automated, AI-assisted, or machine learning tools. Haulwerk does not claim ownership of User Content, and any use of User Content for analytics, training, or demonstration purposes will be de-identified and aggregated where reasonably possible.
9. Prohibited Conduct
You agree not to:
- Provide false or misleading information
- Interfere with platform operations
- Circumvent fees
- Use the Haul Service for unlawful purposes
10. Disclaimer of Warranties
THE HAUL SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
HAUL DISCLAIMS ALL WARRANTIES, INCLUDING:
- IMPLIED WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
This disclaimer does not apply to any warranties or consumer protections that cannot be excluded under applicable law.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAUL SHALL NOT BE LIABLE FOR:
- PERSONAL INJURY
- PROPERTY DAMAGE
- THEFT
- LOST PROFITS
- SERVICE PROVIDER ACTIONS OR OMISSIONS
- MUNICIPAL OR DISPOSAL VIOLATIONS
To the maximum extent permitted by law, Haul’s total liability for any claims arising out of or relating to the Haul Service shall not exceed the lesser of $100 or the total amount you paid to Haulwerk in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits any rights that cannot be waived under applicable law.
12. Indemnification
You agree to indemnify and hold harmless Haulwerk from any claims arising out of:
- Your use of the Haul Service
- Your interaction with Service Providers
- Your violation of these Terms
13. Arbitration & Class Action Waiver
PLEASE READ CAREFULLY.
- Any dispute shall be resolved by binding arbitration
- Arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules
- Governing law: California
- Venue: Los Angeles County
- No class actions or representative claims
- You may opt out within 30 days by emailing support@haulwerk.com
Nothing in this Arbitration Agreement limits your right to file a complaint with, or seek relief from, any applicable governmental, regulatory, or consumer protection agency, or to pursue claims in small claims court where permitted by law.
14. Termination
Haulwerk may suspend or terminate your access at any time for any reason.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
